Thanks for the advice.
I've since found that the jetty daemon starts up with no issues if it is run as root. This obviously isn't ideal. I'm digging through config at the moment trying to workout why it doesn't run as the jetty user.

Ad Windows:
Maybe you shold monitor (sysinternals tools) the file access as the path is relative.
On a Windows 2012 R2 I had problems with some axis2-tempdir under c:\program files\ - looked like the UAC made the problems because as I moved the directory to c:\ the problems disappeared (directory and file access unmodified).
