I definitively support the creation of such a policy by the
Shibboleth consortium.

(Though what you can achieve with that is unclear to me, other than
making it clear from the beginning that using information gatherd
though the list and its archives for purposes of UCE is unwanted.)

While the list owners can easily remove offending people/companies
from the list membership itself (preventing them so send to the list),
this will do little to stop them from getting subscriber addresses
from list archives (of which there are plenty, not all of them
obfuscating/hiding email addresses) and sending UCE to subscribers
directly (as in this case).

Also note that what Nate described as "good business" might be illegal
in other countries, no matter the location of the sender (though
obviously that will influence your chances of getting legal action
going against the sender).
