IdP 2.3.8 missing Servlet API?

I recently went through a pretty fresh install of IdP 2.3.8 and in
the course of testing with aacli.sh ran into the bug described by:
<https://bugs.internet2.edu/jira/browse/SIDP-422>.

I resolved problem by copying servlet-api-2.4.jar to idp/lib as described
in the linked/archived shibboleth-users thread at:
<http://thread.gmane.org/gmane.comp.web.shibboleth.user/14878>

Since SIDP-422 (ca Oct 2010) was marked as closed/fixed though, I was
surprised to see that this was still an issue in 2.3.8. A cursory search
of the documentation at shibboleth.net for "servlet-api" didn't turn up
anything obvious.

While on this topic, I noticed that servlet-api-2.5 is now available.
Would it be recommended to use this version instead?
