Attribute queries rely on SOAP, that's why the back channel is generally confined to legacy SPs or people doing more advanced things. By legacy, I mean Shibboleth SPs that support only SAML 1.

The IdP decides here. If it wants to push attributes in all cases regardless of protocol version, it can.
